1. What we are — and what we are not
FDA Filing Service is a private, independent filing-preparation service. We are not the U.S. Food and Drug Administration (FDA), and we are not affiliated with, endorsed by, or acting on behalf of the FDA or any government agency.
You can register a food facility with the FDA directly, free of charge, through the FDA's own systems. Our fees pay for our work: preparing, submitting, and managing your filing for you, and — where purchased — serving as your U.S. Agent.
2. Services and fees
We offer the following flat-fee services, priced in U.S. dollars and payable in advance through our website:
- Foreign food facility registration, including first-year U.S. Agent service — $199
- Annual U.S. Agent service (each subsequent year) — $149
- Biennial registration renewal — $149
- Domestic (U.S.) food facility registration — $149
- Change of U.S. Agent — $149
- FDA PIN recovery — $99
All services are one-time payments. We do not offer subscriptions and we never charge you automatically. Renewal and agent-service reminders are sent by email; any future service requires a new purchase by you.
3. Your responsibilities
Our work depends on the information you give us. You agree to:
- Provide complete and accurate information about your facility, its owner and operator, and its activities, and to review the details we prepare before submission when we ask you to.
- Tell us promptly about changes (address, ownership, operations, contact details) that could affect your registration.
- Respond to requests for information or confirmation within the timeframes we give you. Some FDA steps — for example, a U.S. Agent change — require confirmation by other parties or within FDA deadlines. We are not responsible for delays or failures caused by missing, late, or incorrect information, or by third parties.
4. Turnaround
We begin work when we receive your completed intake form and payment. We normally submit a filing within 2 business days of receiving complete and accurate information. FDA processing times are outside our control and are not guaranteed.
5. U.S. Agent service — scope and limits
Where you purchase U.S. Agent service, we agree to be designated as your facility's U.S. Agent in the FDA's registration system for the applicable term (the first year is included with a foreign registration; each subsequent year is a separate $149 purchase).
As U.S. Agent, our role is the one defined by FDA regulation (21 CFR 1.227): to serve as the FDA's point of contact for communications with your facility, and to pass those communications on to you at the contact details you provide.
The U.S. Agent is not responsible for your facility's compliance with FDA requirements, the safety or labeling of your products, or the accuracy of the information in your registration. Responsibility for your facility and its compliance remains entirely yours.
If your U.S. Agent service term ends and is not renewed, you must designate another U.S. Agent. The FDA may void the registration of a foreign facility that has no valid U.S. Agent.
6. Refunds
- Before we begin: if you cancel before we have started work on your filing, we refund your payment in full.
- After work has begun: if we have prepared or submitted your filing, the fee is earned and is not refundable.
- Our errors: if we make an error in a filing, we will correct it at no charge. If we are unable to complete a service you purchased, we refund that service in full.
- U.S. Agent service: the fee for an agent term that has begun is not refundable, because our designation and availability as your agent cannot be retroactively undone.
- Refunds, where due, are issued to the original payment method.
7. No guarantee of FDA outcomes
We prepare and submit filings carefully and in accordance with the information you provide, but FDA decisions — including registration, confirmation, or enforcement outcomes — are made solely by the FDA and are not guaranteed.
8. Limitation of liability
To the fullest extent permitted by law, our total liability arising from a service is limited to the fee you paid for that service. We are not liable for indirect, incidental, or consequential losses, including lost profits or losses arising from FDA action taken on information you provided.
9. Governing law
These Terms are governed by the laws of the State of South Carolina, USA.
10. Changes
We may update these Terms from time to time. The version in effect when you purchase a service governs that service.
